    Good morning all,

     

    What is everyone using as the time frame for termination without cause in your radiologist contracts? 90 days? 180 days? Is one 'better" than the other?

    We use 90 days for employed physicians. Physicians who make Partner sign new contracts with 180 day language.

    The thought is that we couldn’t use a year even though it could take that long to recruit.

    For the employed physicians, 180 days would be too long for either side potentially.

    Joanne,

    We use 90 days written notice for termination without cause.  Once a radiologist submits his / her resignation, we understand that it will take us a while to recruit a new radiologist.  

    However, the 90 days has been convenient when our group has decided to terminate a physician.   Depending upon the circumstances, we have termed a doctor without cause (instead of for cause), paid the 90 days of base pay, and had the doctor leave immediately.  

    The alternative of course is immediate termination for cause.  However, sometimes a legal dispute arises with the "for cause termination" and it has been easier and less expensive to just pay the 90 days base pay per our employment agreements.

    I agree with Jay's comments.  but will add, for an amicable split or retirement, 180 days is better to be able to recruit, credential, licensing, etc to get the new rad able to start work (and get paid for services!)
