  • 1.  Pregnacy policies for female radiologists and time off

    Would love to hear what groups have as far as pregnancy policies:
    1)  How much time off can they take unpaid?  
    2)  Do groups offer X number of weeks of paid time off? 
    Any other thoughts on this subject would be greatly appreciated.

    You might want to check the archives, as I think this question was asked not long ago.

    Even though we're not quite large enough to be covered by FMLA, to be competitive with those that are we offer up to 12 weeks.

    Our compensation model is based on days worked, so all time off is without pay, and this is no exception.

    We also are not large enough to be formally covered by FMLA.  However, we allow the radiologist to take up to 12 unpaid weeks off.  We also allow the radiologist to rearrange their vacation days within reason to cover some of the unpaid time if they choose to do so.  This minimizes the impact of not getting paid.  However, we do not routinely "advance" vacation not yet earned.    

    Some states have their own laws concerning pregnancy leave.

    Would love to hear from some of our lurking legal eagles on this one.  There are Federal laws other than FMLA which apply here, as well as other state laws.  Of particular concern is that a woman be given an adequate amount of time off commensurate with her particular health status during the "disability", and that pregnancy be treated at least equally in all respects with other disabilities.  This would include looking at the historical pattern of behavior of the group related to other radiologists' experiences with extended illnesses or temporary disabilities, i.e. flexibility to use vacation, special interim compensation arrangements, unique schedules upon initial return to work, etc. In my experience, there are a host of traditional patterns, written and unwritten rules from the male-dominated era of radiology that not only no longer apply, but that are fraught with liabilities for discrimination claims.

    Here's what we presented after receiving Guidance from our HR Consulting Group:

    Maternity v. Paternity Leave:

    ´A leave of absence shall be granted to regular employees for pregnancy purposes.  Connecticut law requires that a leave of a reasonable period be granted for the period of disability resulting from pregnancy.  The start of this leave will generally not be more than 45 days before expected date of delivery, and will generally not extend more than 91 days past the date of delivery.

    ´Maternity leave is a covered benefit because pregnancy, childbirth and related conditions are defined as disabilities under CT General Statue46a-60(a).

    ´As paternity is not defined as a disability, RAM does not offer parental leave benefits, however spouses and domestic partners may request to use their accrued time off to bond with the child, or request an unpaid leave of absence if business demands allow.
