    Good morning Forum,

     

    I'm interested in knowing if your practice purchases cyber insurance and if you do what the policy liability limit is.  Thanks.

    We receive $1,000,000 cyber insurance policy as part of our malpractice coverage with one of our hospital partners insurance group.  What we learned is to look at the sub limits that apply.  $1,000,000 doesn't necessarily mean you get $1,000,000 coverage.  The policy may only cover $100,000 for court and legal costs as an example.

    ​Limits on cyber insurance should be proportionate to the group's specific exposure, which means considering the number of records stored or resting in your systems and the size of a breach if the systems were compromised.  Your broker should have current data on the average cost of a breach per record.  Also important to carefully review the exclusions and sublimits, much of the cost associated with a breach is related to notifying the patient and potentially offering credit protection. The cyber policy should include coverage for the costs of responding to any regulatory investigation or a regulatory action that results from a breach.

    Great points from Paul.  Another important thing to look at is what you are attesting to in the cyber policy application and your internal HIPAA/IT compliance framework, procedures and practices. There have been known cases where the insurer refused to cover the provider despite the policy because the provider failed to follow minimum required security practices and thus the breach was due to the provider's negligence.
