  • 1.  Collaborative Agreement?

    Forum - When hiring a PA, would you typically have an attorney write the Collaborative Agreement? Or is it usually written by a practice admin/physician?

    For Kansas, there is a standard document prepared by the state, so we used it.  We had a healthcare attorney draft the CPA for Missouri.

    Forgive my ignorance, but what exactly is a Collaborative Agreement? We just have an employment agreement with PAs, so now I'm wondering if this is something different that I might be missing? I don't understand what standard form the state might have for this kind of arrangement where the PA works directly for the group.

    I suspect the name varies by state, but its a supervision agreement that lays out the MD who supervises the PA.  Washington's link is below, and Nevada probably has its own too.

    The collaborative practice agreement generally spells out what the APP can do and how they will interact with the supervising physician(s).  Some states have a standard form.  In others you will have to draft from scratch, likely with the assistance of a healthcare attorney.  I believe they're required in most if not all states.

    Check with the state agency that licenses PA's, usually the same one that licenses physicians.  For Nurse Practitioners check with the state Nursing board.

    Thanks to you both for your help on this. I have come to learn both from our PA and from Dave's comments above that this document applies to PAs, but Nurse Practitioners (which is the position we have in our group) are not affected by this because they report to the nursing board. I'm glad to have learned the distinction in requirements for documentation so that in the event we hire any PAs and not NPs in the future, I will be cognizant.

    You may have checked with your state nursing board and found otherwise, but in most states Collaborative Practice Agreements are also required for Nurse Practitioners.
