  • 1.  Paying for Nighthawk Coverage

    If a hospital-based radiology group has a contract with a nighthawk service for preliminary reads, could the hospital pay for the nighthawk coverage, or would that be considered a violation under Stark (or other similar statute, e.g. anti-kickback)? Are there any circumstances where this sort of arrangement might be acceptable?

    Tom,
    Our group had a provision for Night Hawk in our contract and we did negotiate a stipend for part of the cost.
    However, the last 2 hospital changed to a stipend for meeting measure and did not include Night Hawk cost.

    Tom,

     

    We had an arrangement similar to James' group where the hospital paid part of the nighthawk cost.  In the most recent contract negotiation the Hospital will no longer be paying part of that expense at the end of the 4 year contract.  They are paying us more to attend meetings, etc.  Feel free to call if you have any other questions.
