  • 1.  SELF PAY COVID-19 Rapid Test

    Hello Forum,

    We have a practice interested in administering COVID-19 Rapid Tests as self-pay for insured patients.  Seeing some confusing/conflicting information about if this is alright.  Can an insured patient agree to pay out of pocket for a test that may be covered by insurance? 

    In this scenario, there would be no physician order originating the test. Appreciate any insights! Thanks!

    Patients can always exercise their right under HIPAA to instruct that a claim not be filed, and providers can collect at time of service for such services.  It's best to get this instruction in writing, along with an agreement not to ask later that a claim be filed.

    I have no idea how CLIA applies to COVID testing, but that would be something to research, since it generally applies regardless of insurance coverage.

    In addition to David's concerns with CLIA I would question if there is mandatory reporting of COVID results to your local Health Department. If the reason the testing is being done "out of pocket" is to protect the results from disclosure it may not be possible with reporting requirements.... As an example – STDs fall into the mandatory reporting class, offering to perform a test and not report a positive to the health department could result in the suspension or revocation of the providers license.....   Hope that helps....

    Why would they?

    Is that practice making such mandatory before doing the exam?

    If so, are they afraid that their competition will scoop up these patients for such request?
