Medicare Contrast Supervision Guidelines

    Hi,

    Does anyone have the Medicare guidelines pertaining to Physician supervision for CT and MR contrast injections?  Can a NP/PA monitor?  Does the person monitoring the injection have to be in the MR suite, same floor, or same building?  If someone can give me a copy or link to the actual Medicare rule/regulation regarding the monitoring of MR and CT IV contrast administration in both IDTF and Physician Office settings, that would be great.

    Supervision can only be performed by a physician, and in general it's Direct Supervision, meaning the physician must be present in the office suite.  If you download the RVU file from the CMS website, there is an indicator for the required level of supervision for each code.

    For an IDTF setting, check your MAC's IDTF LCD.  I seem to recall that in an IDTF setting, the supervising physician also has to be qualified to interpret the study, but it's been a while since I looked at that.

    Thanks, David!

    So I looked up a few codes (for procedures that definitely need Physician supervision) on the CMS site using the fee schedule look-up tool for Payment Policy Indicators and they are all showing "09" under the "Phys Supv", which means "concept does not apply".  How is that possible?  There must be something wrong with the CMS site.

    Any other suggestions?

    Supervision applies to the technical component only, so if you didn't search for the TC modifier, it would show up as 99.

    Has anyone ever used physicians from an adjacent office to cover contrast injections?  We share a building with some internists so we were wondering if we could make an agreement with them to cover contrast injections for days when we don't have staffing for one of our MRI centers.  Anyone ever tried this and if so, how much did you pay?

    Chuck – Your MAC will decide if you can do this. Some MAC's require that it be a radiologist that provides the test oversight, other MAC's allow a trained physician. If your MAC allows any licensed physicians then yes it can be done without much difficulty, but it means the covering physician has to be ion your suite to meet the supervision requirement, not next door.... Hope that helps....

    If there are multiple Physicians present in our office, does it matter which one gets assigned to the -TC component? Can we assign credit to any doctor in the office on the same date of service as the performance of the study with contrast? The other practice provides the interpretation report (-26) and mentions the images were taken at our location (to support the -TC)​ and one of our remote rad docs will do a "quality control" sheet but I believe coders are to ignore this QC sheet and just assign the CPT code with TC modifier and then give credit to any doctor that was at that location?? Am I on the right track?

    Hi Jennifer

    I'm not sure what you mean by assigning credit.  If you mean which doctor's name should appear on the claim, it would seem to make sense to use the name of the one that was present to supervise.

    If you're an IDTF, or the physicians in question are not radiologists, there might be other factors to consider.

    With respect to supervision of contrast studies, what I have seen most commonly is that a schedule or log is maintained to record the name of the physician and the time they were in the office, in case documentation of supervision is ever requested by Medicare (rare unless there is a complaint).  I'm not sure they would consider a claim to be documentation of supervision.

    Here are some resources.  Medicare requires direct supervision by a physician (not an NP or PA) for "with contrast" studies.  This is for both the office and hospital outpatient setting.

    The Centers for Medicare and Medicaid Services corrected the technical component physician supervision levels for contrast procedures and fluoroscopic guidance codes in the Medicare Physician Fee Schedule database. The revisions were implemented on April 7 and are retroactive to Jan. 1, 2014. The procedures with contrast have been corrected to a level "02", defined as "procedure must be performed under the direct supervision of a physician." Fluoroscopic guidance codes have been revised to level "03" defined as "procedure must be performed under the personal supervision of a physician."     The term "in-office ancillary" commonly refers to one type of exception from the Stark Law that otherwise prohibits referrals for Designated Health Services such as imaging if the ordering provider has a financial relationship with the rendering person or entity.  The supervision rules we've been talking about in this thread apply to all physician offices, including those attempting to fit into the "in-office ancillary" exception.

    If you are trying to fit into the Stark "in-office ancillary exception", the core supervision requirements are the same, but I believe there may be some additional nuances with respect to the relationship between the ordering clinician/group and the physician providing supervision.  Probably best to talk to legal counsel about specifics.

    I have noticed that the outside interpretation reports (professional component) will sometimes mention in their technique area that the images were taken at our office. Is it ideal that they document the -TC part this way, or is a header with both office addresses in it sufficient?
