    Good afternoon

    My understanding is that medical records need to be kept for 7 years, my understanding is this includes billing records, is this correct?

    We switched practice management systems last year, I was wondering how other practices handled a transition like this. We are currently have access to both systems however at one point we will no longer have access to our old system

    This is probably a good question to pose to healthcare legal counsel.  The answer for both medical records and billing records will largely depend on various statutes of limitations, which may vary depending on state law.

     

    In the past, when I have shut down old billing systems, I have dumped account records off to a set of text files that can be accessed if needed even if the system is no longer operational, and retained those for the required period of time.

    Agree on getting legal opinion. We keep for 10 years, at a minimum.

    Hi Christina,

     

    Medical record retention time tends to be govern by individual state laws.

     

    Medicare Managed plans requires 10 years record retention (Under 42 CFR 422.504(d) and (e)).

     

    HIPAA requires six years from the data creation.

    And don't forget the issue of pediatrics records needing to be held for a number of years after the patient reaches 18.....

    Hi Cristina - 

    As Christi pointed out, Medicare Managed Care plans require 10 years - so that probably drives much of the decision-making for most practices.  

    Also significant to note that in 2017 OIG extended its exclusion authority for Anti-Kickback Statute (AKS) and Civil Monetary Penalties (CMP) violations to 10 years, which is also consistent with statute of limitations for bringing actions under the False Claims Act (FCA).
