I think the key questions would be whether they are providing services to others, paying their own expenses (malpractice, license, etc.), setting their own schedule, etc. If you could answer yes to all of those questions, I think it would be worth checking further with an expert in employment law if independent contractor is your preferred route.

Have any groups found a solid justification for classifying locums radiologists working occasional shifts as Independent Contractors (issued a Form 1099) versus PRN employees with a W2 and all related tax issues/withholdings? Regulations seem to be pretty clear that treating them as a W2 employee is the required option but just checking to find out if we are missing anything. And I am not referring to locums through an agency....these would be locums working directly for the practice. Thanks.
