    Dear Forum,

    I am wondering how many groups have been successful in negotiating data access rights in their hospital PSAs? Have you discussed data access rights during contract negotiations and if so, can you share your experience.

    Hi Janet

    Can you elaborate a bit on what you mean by data access rights?  Our PSA's generally have language related to what data is transmitted and how it can be used.  Access to hospital systems is generally governed by hospital policies, but perhaps I'm missing something.

    I noticed my hospital contract contains no language specific to access to data such as results, workflow, image quality, and billing data access rights. We do have access to billing data but it is not specifically noted in the contract, which seems like an oversight.

    I hope to learn about other group's experience negotiating expanded data access and if the data was useful operationally?

    Our agreements generally provide that hospitals will send all information required for billing and collections, specifically including anything that may be required in connection with AUC in the future, on a daily basis in a mutually agreeable electronic format. 

    All of our hospitals also provide HL7 orders and DICOM images, and we return HL7 results and annotated DICOM images where applicable.  Our newer agreements generally spell this out, but we haven't sought to redo old evergreen agreements to get it added, and in some cases we have bigger controversies to deal with than getting this added at renewal.  

    We also send the hospitals image quality review, TAT and Peer Learning data, but I think only two of our agreements talk about that.

    There is a trend towards very restrictive language around how data from the hospital can be used.  We generally try to get a broad exception to use data for purposes of patient care and reimbursement.

    There is usually also language about protecting shared data consistent with HIPAA standards.

    In addition to the items Dave mentioned, there should be a provision that provides access to patient records for the purpose of legal defense.  That access should have no time limits, i.e. it should extend in perpetuity.
