  • 1.  Letter re: not billing insurance

    I know that HIPAA allows the patients to tell the provider that they do not want their claim filed to insurance but I haven't had anyone ever ask to do that.  I have one now and I was wondering what type of document you are using to document this request from the patient.  Do you have them sign something in advance?  Any guidance would be appreciated.

    We have them sign a self-pay agreement form.  It states that insurance will not be filed now or at a later date. The caveats to filing at a later date are that after you file they may owe you more than the self pay price agreed upon and they won't like that.  Also, you want your billed charges consistent throughout so you may have to increase them to full price before submitting your bill to the carrier.  OFTEN, they come back and say they want to file it now to meet their deductible because now they need surgery, etc.  You may run into that, but we elect not to file in that case since they signed the self-pay agreement form.     ​Good Morning Wendy,
    We have a form for "Request Not to File Insurance" that the patient signs and dates...It includes the patient's name, account number, and type of exam(s).  It states that the patient has requested that ARA not bill their insurance company for the exams listed and that the patient acknowledges that they are agreeing to be personally responsible for payment of all services and that they understand that we cannot file a claim with any insurance entity at a later dater for these services.

    We then process the patient as a self pay and give any self pay discounts offered and collect at the time of service.  I hope that helps.

    Hello,

    Patient's can request a restriction in that their service(s) not be filed to their health insurance - but my opinion is they should not receive self pay discounts in this instance:

    A covered entity, such as a doctor must agree to an individual's request to restrict disclosure of their PHI to a health plan if:

    • the disclosure is for the purpose of carrying out payment or health care operations and is not required by law; and
    • the PHI only pertains to an item or service for which the individual has paid in full.
