    Hello - There was an earlier thread regarding maternity leave that I revisited, but I am looking for some more information/guidance on how other private practice groups handle paternity leave specifically.  Outside of FMLA and using PTO, do you allow anything else such as borrowing PTO from a future year?  And do you allow a certain amount of time?

    Hi Kelly, our group is knee deep in this discussion.  We have not finalized anything yet but here is a general overview of where we are: We are about 30 rads and a few employees so not subject to FMLA.

    1. Our attorney advised that we are subject to Equal Employment Opportunity Commission (EEOC) which delineates between recovery time for the birth mom and bonding time for the non-birth parent. The EEOC apparently states that whatever time off an employer provides beyond the recovery time of the birth mom should be identical for any parent, regardless of gender or sexual orientation. Otherwise there is risk that the policy could be considered discriminatory. 
    2. As a result of this we are splitting our policy to talk about recovery time versus bonding time.  Recovery time applying to the birth giving mom and baby bonding everyone else.  Ex: same sex couple adopts etc. they fall under baby bonding.
    3. Current proposal: (not approved yet)
    a. Recovery time: 6 weeks, 3 weeks taken from PTO 3 weeks unpaid
    b. Baby bonding time: 2 week, both weeks are from your PTO 
    *FYI they get10 weeks PTO

    There is a lot of concern about how we will cover staffing while people are out under this policy.  Although we are decent size our staffing model is tight, volumes are up as everyone is experiencing and good locums are hard to find. So our policy isn't super generous as a result. Hope this is somewhat helpful.

    Our policy is part of the unpaid/paid leave policy.

    It is a little long but if covers most situations.

    Kelly in addition to Christin's comment – you need to check your State statutes, many have started establishing requirements beyond FMLA as to the hours required to qualify or the total number of employees an employer must have to require meeting the leave time requirements. As an example – Illinois just passed a law for all that drops the hours for participation to 1000 in a 12 month period instead of 1250 for all employees in educational settings and the State is discussing broadening that to cover other industries and healthcare is on the list....  Hope that helps.
