    Hi All,

    For those of you with JV's with your hospital, are your physicians having to go through testing and make additional profit sharing contributions to the employees of the JV each year because of the ASG rules?  This is becoming quite expensive for my group because the JV plan vs the physician plan/HCE's to max their annual amounts allowed,.

    Any insight would be greatly appreciated.

    Holly – What you outline is frequent if the JV was not developed addressing that concern upfront. The Affiliated Service Group (ASG) rules under ERISA are relatively stringent and require that the "richest" plan be utilized for calculation of retirement benefits for leased personnel or utilize a 10% rate as a type of "stop loss", but only if the retirement plans are constructed to allow that default. There are ways to overcome this issue, but they would all involve amending your current retirement plan in very specific ways that would not interfere with the contributions levels....
